What parts of the Milliman Care Guidelines are copyright protected?

All portions, versions, and releases of the Milliman Care Guidelines, in all media, are copyright protected and fall under the U. S. Copyright statute.

As a licensee of an enterprise electronic version, how much of the Milliman Care Guidelines can be copied?

The license agreement expresses Milliman’s detailed permission to distribute copies of the Milliman Care Guidelines. Permission to copy is limited to what is specifically expressed in the license agreement. Examples of authorized duplication for electronic licensees include:

  1. To give a provider information regarding the tools used in review criteria; licensee may copy individual guidelines as applicable;
  2. To provide a sample of Milliman Care Guidelines for internal training programs; licensee may copy the equivalent of three individual guidelines;
  3. In order to support the appropriate use of the Care Guidelines as tools, and to avoid the use of the Care Guidelines in a rigid fashion without consideration of individual patient circumstances and needs, licensee may copy the individual guidelines used as reference aids relative to a specific case review decision;
  4. To distribute patient educational materials included in the Chronic Care Guidelines in print format to patients if the Chronic Care Guidelines is one of the Products licensed and if the materials distributed relate to the particular patient's condition;
  5. To provide as documentation in development of customized critical care pathways; licensee may copy the equivalent of one individual guideline for each pathway being developed;
  6. To post in a patient record for easy reference, licensee may copy the individual guidelines used with respect to such patient.

Other Uses?

  • To incorporate specific sections, such as scope of responsibilities for primary care physicians, in a contract; please call Client Services to discuss specific request (see the "How do I get special permission" section, below)
  • To create easy-to-access reference sub-sets of the Milliman Care Guidelines for specific departments, for example to provide the ER department with admission criteria for the most common adult and pediatrics diagnoses; please call Client Services to discuss a specific request (see the "How do I get special permission" section, below)

What copying of the Milliman Care Guidelines is not permissible, under any circumstances?

  • To routinely copy the Milliman Care Guidelines from a central repository or duplication department
  • To provide Care Guidelines for training of personnel who are external to the organization and are not authorized to use the Care Guidelines pursuant to Licensee's Master License Agreement with Milliman

How do I get special permission to make copies of the Milliman Care Guidelines material, as specified above?

  • Send Client Services a letter or fax (206.464.7813) or e-mail us at support@milliman.com describing the reason for the request, defining the specific Care Guidelines or subsets to be duplicated, the number of duplications requested, to whom the duplications will be distributed, and contact and telephone information of the requestor.
  • Wait until Milliman sends permission before proceeding with duplication.

Using Milliman Care Guidelines Effectively

The Care Guidelines are written in a clear, direct style because they are, quite simply, guidelines for providing the right care at the right time in the right setting. They show what can be accomplished under the best circumstances and should be used in conjunction with medical judgement about an individual patient. When used effectively the Care Guidelines serve as benchmarks which support:

  1. the reduction of unexplained variation in healthcare practice
  2. education of practitioners and health care delivery systems
  3. the continuous improvement in processes that enhance patient outcomes

For purposes of accreditation, the Care Guidelines can be used as a framework for meeting the standard for updating and review of practice guidelines. This process supports Milliman, Inc.’s perspective that the Care Guidelines are used most effectively when they are reviewed by local physicians and healthcare managers and adapted as necessary to reflect individual patient and population needs as well as the organization’s unique care delivery system.
